One of our drivers produced his driving licence when he first started working for us 2 years ago but despite numerous attempts has failed to produce it again for our records. What should we do?
Answer
Any attempt to withhold information from the company that may then cause the company to be in breach of health and safety regulations could be construed as gross misconduct. If you had a copy of the licence at the start of employment you could check the licence number against DVLA records to establish whether there are any penalties.
