This policy explains the process to be used for all dismissals, whatever their circumstance; whether redundancy, misconduct, poor performance etc.
Question
I have an employee who has been employed by us for less than a year. Performance seems OK although nothing outstanding but they are just not fitting in with others in the office. I want to let them go. What should I do?
Answer
For any dismissal you must follow the ACAS Code of Practice. With any situation of this kind it is always best to exhaust all other avenues first. It is possible to terminate the contract of this employee if the situation is deemed irretreivable. You must also be careful that the notice period does not take the employee over the 1 year's service threshold.
